Overview

Ascendra-X is committed to complying with Canada’s Anti-Spam Legislation (CASL, S.C. 2010, c. 23) when sending commercial electronic messages (CEMs) to Canadian recipients as part of our B2B demand generation programs.

What is CASL

CASL is a Canadian federal law that regulates commercial electronic messages, including email, SMS, and social media messages sent to Canadian recipients. It requires senders to obtain consent, identify themselves, and provide a functional unsubscribe mechanism in every commercial electronic message.

Before sending a CEM to a Canadian recipient, Ascendra-X ensures that one of the following consent conditions is met:

  • Express consent— The recipient has explicitly opted in to receive the type of message being sent, with clear documentation of when and how consent was obtained.
  • Implied consent— An existing business relationship exists (e.g., the recipient made an inquiry, purchased a service, or entered a contract within the last two years), or the recipient’s business contact information has been conspicuously published without a statement that the person does not wish to receive unsolicited CEMs.

We maintain records of consent including the method, date, and purpose for which it was obtained.

Sender identification

Every commercial electronic message we send on behalf of ourselves or our clients includes:

  • The name of the person or organization sending the message.
  • The name of the client on whose behalf the message is sent, if applicable.
  • A valid mailing address and at least one of: a telephone number, email address, or web address.

Unsubscribe mechanism

All CEMs include a clear, prominently placed, and functional unsubscribe mechanism that allows the recipient to opt out of future messages. Unsubscribe requests are processed within 10 business days as required by CASL, though we aim to process them within 48 hours.

Compliance program

Our CASL compliance program includes:

  • A centralized suppression list that is updated in real time across all campaign channels.
  • Pre-send compliance checks to verify consent status for Canadian recipients.
  • Staff and contractor training on CASL requirements.
  • Regular audits of consent records and sending practices.
  • Documented escalation procedures for complaints.

Client responsibilities

When Ascendra-X sends CEMs on behalf of a client, the client is responsible for confirming that valid consent exists for the intended Canadian recipients. Our client agreements include CASL compliance warranties and indemnification provisions.
